Iminungkahi ng Senate panel ang paghahain ng graft at perjury charges laban sa ilang dati at kasalukuyang opisyal ng Department of Education (DepEd) at Department of Budget and Management Procurement Service (PS-DBM) kaugnay sa “highly irregular” laptop procurement project noong 2021.
Sa report na inilabas nitong Huwebes, Enero 19, inirekomenda ng Senate blue ribbon committee ang mga sumusunod na reklamo laban sa mga dati at kasalukuyang opisyal:
*One count of violation of Section 3(e) of Republic Act 3019 or the Anti-Graft and Corrupt Practices Act against (causing undue injury to the government):
- Former DepEd Undersecretary Alain del B. Pascua
- DepEd Undersecretary Annalyn M. Sevilla
- Former DepEd Assistant Secretary Salvador C. Malana III
- Director Abram Y.C. Abanil
- Former PS-DBM OIC Executive
- Director Lloyd Christopher Lao
- Former PS-DBM OIC Executive
- Director Jasonmer L. Uayan
- Bids and Awards Committee (BAC) Chairman Ulysses E. Mora at iba pang miyembro ng Special Bids and Awards Committee I at SBAC technical working group and Secretariat, mula Deped o PS-DBM.
- Engr. Marwan O. Amil
*One count of violation of Section 3(g) of RA 3019 laban kina Pascua, Sevilla, Malana, Lao, Uayan, Mora, ant iba pang opisyal at secretariat ng SBAC.
Inirerekomenda rin ang reklamo laban sa mga principal, representative at ahente ng Joint Venture consortium partners at iba pang pribadong partido sa pakikipagsabwatan sa mga nabanggit na opisyal.
*Falsification of Public Document by a Public Official under Article 171 ng Revised Penal Code laban kina Sevilla, former Executive Assistant Alec Ladanga;
*One count of violation of Section 3(a) of RA 3019 laban kina Sevilla at Ladanga.
Ang Section 3(a) ay ang “unlawful for any person having family or close personal relation with any public official to capitalize or exploit or take advantage of such family or close personal relation by directly or indirectly requesting or receiving any present, gift or material or pecuniary advantage from any other person.”
*Multiple counts of Perjury under Article 183 ng Revised Penal Code laban kina Sevilla, Pascua, Malana, Lao, at Uayan.
Matatandaan na noong Agosto 2022 ay inilunsad ng blue ribbon committee ang imbestigasyon kaugnay sa pagbili ng outdated pero mamahalin na laptop ng DepEd sa pamamagitan ng PS-DBM.
Nakatakdang humarap sa DepEd spokesperson Michael Poa ngayon ding araw upang magbigay ng pahayag kaugnay ng mga obserbasyon ng blue ribbon committee.
