PATAWA: Police power is power of the police! Church-State separation means they are separate!

The Philippines like any other democratic, republican states has an inherent power to protect citizens and to protect means the common good must prevail – not the interest of the few. Speaking of iilan or some individuals, no Church or any religious denomination or sect must receive certain favor from the State because the separation of Church and State must be inviolable.

What must we do or undo in order to “promote the common good” [“…(to) conserve and develop our patrimony, and secure to ourselves and our posterity the blessings of independence and democracy under the rule of law and a regime of truth, justice, freedom, love, equality, and peace”]? (Preamble of the Constitution, 1987)

Heavy stuff. But we can count the Police Power ways without need of license to practice the legal profession because ignorance of the law excuses neither you nor me from compliance therewith (“ignorantia legis non excusat”):

Government regulations are in place. Without regulating freedoms/rights/privileges, governance cannot effectively maintain order and majesty of law. The judicial bodies and quasi-judicial ones, the local government units, and the national departments, offices, commissions, agencies, bureaus, and task forces regulate their actions and ours. You struggle for nine long months, give birth to, and raise a child, you cannot say, “It’s my turn to be served by the child.” (You cannot tell that to the government either.) Under the Family Code, Civil Code, the 37-year-old charter’s declaration of principles and State policies, bill of rights, universal declaration of related rights, and social welfare (DSWD) and education (DepEd) departmental operations, you (and people in government, too) are duty-bound to send your child to school like any other parents or guardians. While privately-owned schools, colleges, and universities, help the government in the educative mission, they are not allowed to haphazardly impose their own standards and undertakings like tuition hikes, and hiring and firing processes. Owners of private institutions know fully well that while they may exercise management prerogatives, labor force disputes and doubts must generally be resolved in favor of labor.

Thus, Police Power is not the power of the police. When erring cops are ashamed before the sala of a judge, that judge and all of us possess no original plan of pamamahiya (shaming). The primordial goal of correcting the detected wrong of not just the policewomen and men but also all the women and men? So that the right must be maintained, the wrong be detected and be punished and, ultimately, the common good be promoted.

Enter Robinhood. The good-looking – or good senator and husband of a fellow actor (na maganda na, kung bakit kailangan pang…?) – is correct in his knowledge that there is a constitutional law on separation between Church and State. He may also have the tacit knowledge that it “shall be inviolable.” Who knows? What needs to be rectified (by his staff, by his fellow senators, by us if they do not do that) is his own interpretation of the Church-State separation which comes on the heels of inquiries by both chambers of Congress on his friend “Appointed Son of God” Apollo Quiboloy who is wanted by the FBI, with California judge Terry Hatter Jr. unsealing the warrants against the Davao City-based (not anymore?) televangelist and other defendants last week “upon application of the government and for good cause shown.”

“Strong fences make good neighbors,” says a maxim which is almost always used in court decisions and mentioned in Justice Isagani Cruz’s award-winning book Philippine Political Law (2002). The strong fences indicate the demarcation line, and the good neighbors are the Church and State. This resembles Jesus’ teaching on “render unto Caesar” in Matthew 22:21. Moreover, there are some of us who, albeit without considering themselves as part of dominant religious groups, are constitutionally protected anyway. The doctrine of separation can also be understood by using the totality of the Constitution, including the non-establishment clause and the free exercise clause both found in Section 5 of the Constitution’s Bill of Rights. (Bernas, n.d.)

This religious group’s statement has been duly noted by an SC decision: “The separation of Church and State prohibits the State from interfering in Church matters, and prohibits the State from having a State religion. It does not imply a division between belief and public actions, between moral principles and political choices. In fact, the freedom of religion upheld by our Constitution protects the right of believers and religious groups to practice their faith and act on their values in public life. The Constitution guarantees the right of each citizen to exercise his or her religion… (Their) moral convictions (brought) into public life do not threaten democracy or pluralism but rather enrich the nation and its political life… The exercise of this faithful citizenship means that when they go to the polls to vote they should not leave God.” (CBCP, 2009)

Padilla contends that holding the “Appointed Son” in contempt encroaches on religion and goes against the Church-State separation. Indeed nothing can separate us from the actor-turned-politician’s patawa.

The survey reveals that Italians are reducing their consumption of olive oil due to a surge in prices

MILAN. A recent survey released on Friday indicates that one-third of Italians are reducing their consumption of extra virgin olive oil, a staple of the Mediterranean diet, due to soaring prices. However, Italian producers are challenging this data, asserting that sales of higher-quality Italian extra virgin olive oil are actually on the rise.

According to a survey conducted by the independent research institute Piepoli, consumers reported scaling back their consumption of extra virgin olive oil by as much as 30% to 50%. This reduction comes as average supermarket prices have surged from 4 euros to 9 euros per bottle. Nearly half of the respondents stated that they were substituting olive oil with cheaper seed oil. The survey, which polled 500 Italian adults, had a margin of error of plus or minus 4.4 percentage points.

While the reported decrease in consumption is less severe than in other olive oil-producing countries in the Mediterranean Sea region, such as Spain, which has experienced a significant drop in production due to two years of drought, leading to a global price increase.

Greece and Spain have both witnessed a one-third decline in olive oil sales over the past year, according to industry estimates.

Despite the softer impact on Italian consumption, the industry is not taking these findings lightly. David Granieri, president of the Unaprol olive-growing consortium, representing half of Italy’s production, emphasized that the higher prices have brought clarity to the market, distinguishing lower-quality extra virgin olive oils from premium varieties.

Contrary to the Piepoli survey, Granieri highlighted industry data indicating an 8% increase in domestic sales of extra virgin olive oil produced in Italy in the first two months of the year, despite prices reaching up to 14 euros per liter.

Granieri emphasized, “Olive oil is not a commodity. It is a nutrient at the heart of the Mediterranean diet and plays a fundamental role socially. This is something that is keenly felt in Italy.”

Piepoli CEO Sara Merigo noted that the survey measured consumer sentiment, which differs from actual sales data. She attributed the pushback against the findings to the deep cultural significance of olive oil in Italy, describing it as “not just a product” but an integral part of the country’s identity and diet for centuries.

SC sa PLDT: 7K na contractual employees gawing regular

Ipinag-utos ng Supreme Court na maging regular na empleyado ang halos 7,000 na contractual employees ng PLDT Inc. na naglilingkod sa larangan ng instalasyon, pagkumpuni, at pagmamantini ng mga linya.

Nagpasya ang First Division ng Korte Suprema na suportahan ang hatol ng Korte ng Apelasyon (CA) na nagpapatunay na lumabag sa mga batas sa paggawa ang PLDT at ang contractor nito.

Binalewala ng Korte Suprema ang mga petitions for review on certiorari ng Manggagawa sa Komunikasyon ng Pilipinas, PLDT, at Silvestre Bello Ill na dating kalihim ng Department of Labor and Employment (DOLE).

Ayon sa First Division, direkta at may kinalaman sa mismong negosyo ng kompanya ang trabaho ng mga naglilingkod sa instalasyon, pagkumpuni, at pagmamantini ng mga linya ng PLDT.

Binigyang-diin ng Korte Suprema na ayon sa Artikulo 295 ng Labor Code, ang regular na empleyo ay batay sa koneksyon ng trabaho ng isang empleyado sa negosyo ng kanyang employer.

“It cannot be denied that without the work performed by these employees, PLDT would not be able to carry-on its business and deliver the services it promised its consumers,” ayon sa desisyon.

Samantala, ibinalik ng SC sa Regional Director ang kaso para sa tamang pagrepaso at pagbatid ng mga isyu.

“As the regularization of these employees entails factual consequences that cannot be determined by the Court, the case was remanded to the Regional Director for proper identification, review, and determination of the factual issues,” ayon pa rin ng desisyon

Samantala, ibinalik ng Korte Suprema ang kaso sa Regional Director para sa tamang pagrepaso at pag-unawa sa mga isyu.

“Yamang ang regularisasyon ng mga empleyado na ito ay may kaugnayan sa mga paktwal na kaganapan na hindi maaaring tiyakin ng Korte, ibinalik ang kaso sa Regional Director para sa tamang pagkilala, pagsusuri, at pagtukoy ng mga paktwal na isyu.”

Inatasan din ng Korte ang Regional Director na suriin at alamin ang epekto ng pagiging regular na empleyado ng mga manggagawa na nasa larangan ng instalasyon, pagkumpuni, at pagmamantini ng mga linya.

Kailangan ding suriin at kalkulahin ng Regional Director ang angkop na pinansiyal na parusa dahil sa mga paglabag sa pamantayan ng paggawa ng PLDT, Inc. at ng kanyang mga kontraktor.

Pope Francis makes public appearance, delivers homily after flu hospitalization

ROME. Pope Francis made a public appearance on Friday, showing signs of good health as he delivered his homily during his first parish visit outside the Vatican this year. This comes after a bout of the flu led him to undergo hospital tests and prompted him to cancel some appointments last week.

Despite still experiencing mobility issues and using a wheelchair instead of a cane, Pope Francis demonstrated resilience as he spoke with a strong voice, occasionally interrupted by coughing. Throughout the week, he had relied on an aide to deliver his remarks to conserve his energy.

During his visit to the St. Pius V church near the Vatican, Pope Francis presided over a Mass and listened to confessions. This outing marked his first parish visit of the year, following the cancellation of some engagements due to what the Vatican described as a mild case of the flu.

On February 28, the Pope was admitted to the hospital for unspecified diagnostic tests, the results of which have not been disclosed. Throughout the winter, he has been grappling with a series of health issues, including colds, bronchitis, and the flu.

Pope Francis, who had part of one lung removed in his youth due to a respiratory infection, often speaks softly, even when not ill. In 2021, he underwent surgery to remove a portion of his colon, and last year, he had an operation to address an abdominal hernia and remove scar tissue from his intestines.

“Ang subject person natin ay nasa proseso ng pakikipag-transaksyon sa palitan ng kanilang mga sasakyan. EU, US, and UAE collaborate on Gaza aid corridor amid fears of famine

CAIRO/LARNACA, Cyprus. The European Commission’s President, Ursula von der Leyen, announced on Friday the imminent launch of a maritime aid corridor between Cyprus and Gaza, aimed at alleviating the escalating humanitarian crisis in the conflict-stricken Palestinian territory.

Von der Leyen’s statement followed President Joe Biden’s announcement of plans for the U.S. military to construct a “temporary pier” along Gaza’s Mediterranean coast, prompted by United Nations warnings of famine looming over Gaza’s 2.3 million inhabitants.

While negotiations for a potential ceasefire in the ongoing conflict between Israel and Hamas have stalled in Cairo, urgent efforts are underway to broker a truce before the start of Ramadan, anticipated to commence on Sunday.

Speaking after inspecting facilities in Larnaca, Cyprus, EU Commission President von der Leyen revealed that a trial run of food aid organized by a charitable organization and backed by the United Arab Emirates could depart from Cyprus as early as Friday.

“We are launching this Cyprus maritime corridor together, the European Union, the United Arab Emirates, and the United States,” she affirmed. “We are now very close to opening this corridor, hopefully this Saturday-Sunday, and I’m very glad to see an initial pilot will be launched today.”

Despite Biden’s description of the planned pier, U.S. officials caution that its construction may take several weeks. In the meantime, reports of malnutrition-related child fatalities in northern Gaza underscore the urgency of the situation. The U.N. emphasizes the importance of prioritizing the expansion of land routes for aid delivery.

Biden clarified that no U.S. troops would be deployed on the ground for the construction. However, the Pentagon anticipates a process lasting “likely up to 60 days,” involving around 1,000 troops, with none being stationed ashore.

“It’s going to take time to build,” noted British Foreign Minister David Cameron, urging Israel to facilitate aid deliveries via its Ashdod port north of Gaza in the interim.

Some humanitarian organizations argue that discussions of elaborate air and sea routes distract from Israel’s restriction of existing land access points.

“There’s an easier, more efficient way of bringing in assistance, and that is via the road crossings that connect Israel with Gaza,” remarked Juliette Touma, spokesperson for UNRWA, the U.N. relief agency for Palestinians.

Michael Fakhri, a U.N. special rapporteur on the right to food, branded the consideration of new aid routes to a blockaded territory as “absurd” and criticized the failure to address the root issue of access restrictions.

“From a humanitarian perspective, from an international perspective, from a human rights perspective, it is absurd in a dark, cynical way,” he asserted.

Inaasahang magkakaroon ng rollback sa presyo ng mga produktong petrolyo sa susunod na linggo matapos ang isang linggong paggalaw, ayon sa Department of Energy-Oil Industry Management Bureau. Ayon kay Assistant Director Rodela Romero, base sa oil trading sa nakaraang apat na araw, magkakaroon ng pagbaba sa presyo ng mga produktong petrolyo.

Ang inaasahang rollback ay ang sumusunod:

  • Gasolina – P0.50-P0.80 kada litro
  • Diesel – P0.20-P0.50 kada litro
  • Kerosene – P0.20-P0.45 kada litro

Depende sa kalakalan ngayong Biyernes, maaaring magbago ang mga taya.

Karaniwang nag-aanunsyo ng mga adjustment sa presyo ang mga kumpanya ng langis tuwing Lunes, na ipapatupad sa susunod na araw.

Noong Martes, Marso 5, ibinaba ng mga kumpanya ng gasolina ang presyo ng diesel at kerosene ng P0.40 at P0.35 kada litro, ayon sa pagkakasunod. Ngunit itinaas ang presyo ng gasolina ng P0.50 kada litro.

Sa kabuuan, ang year-to-date adjustments ay nagdala ng pagtaas na P5.95 kada litro para sa gasolina, P4.05 kada litro para sa diesel, at P0.05 kada litro para sa kerosene.

TOKYO. Renowned manga artist Akira Toriyama, the creative genius behind the beloved Dragon Ball series, has passed away at the age of 68, announced his studio on Friday. Vatican confronts ongoing abuse scandal as Pope meets child protection board

However, as preparations for the report are underway, alarming revelations have emerged from Switzerland, shedding light on a surge in victims coming forward since the release of a damning report last September. The report exposed over 1,000 cases of abuse spanning several decades in a country with a relatively small Catholic population.

In a shocking development closer to home, a Sicilian criminal court delivered a significant verdict this week against a priest previously cleared by the Vatican, despite pleas from one of his victims addressed directly to Pope Francis. The court sentenced the Reverend Giuseppe Rugolo to four and a half years in prison for charges related to attempted sexual violence against minors. Furthermore, the diocese of Piazza Armerina, Sicily, was held accountable for compensating the victims and covering legal fees.

Kinilala ang drug pusher na may mga alias na Ge, 26; Tisay, 45; at ang kanilang mga karamay na may mga alias na Paul, 42; Rudy, 47; at Dhix, 23, ang nakilala ng pulisya.

Dalawa sa limang suspek ang itinuturing na high-value individuals (HVI), habang ang iba ay street level lamang.

Sa isinagawang pag-aresto, nakumpiska ang limang piraso ng sachet na may laman na tinatayang 25 gramo na nagkakahalaga ng P170,000, at 15 gramo na nagkakahalaga ng P102,000.
